Orlando Critical Mass Bicycle Ride Waiver

PLEASE READ CAREFULLY BEFORE SIGNING

This Waiver and Release of Liability ("Waiver") is intended to be as broad and inclusive as permitted by the laws of the State of Florida. By signing this Waiver, you acknowledge that you have read, understand, and agree to the following terms and conditions:

1. Assumption of Risk:

You understand that participation in the Orlando Critical Mass bicycle ride involves inherent risks and dangers, including but not limited to:

  • Traffic hazards: Collisions with motor vehicles, pedestrians, and other cyclists.

  • Road conditions: Potholes, uneven surfaces, debris, and other hazards.

  • Weather conditions: Heat, cold, rain, wind, and other unpredictable weather events.

  • Mechanical failures: Bicycle malfunctions, including tire blowouts and brake failures.

  • Other participants: Actions of other cyclists, including erratic riding and collisions.

You acknowledge that these risks are inherent to the sport of cycling and that you voluntarily assume full responsibility for any and all injuries, losses, or damages that may result from your participation in the ride, regardless of the cause.

2. Release of Liability:

In consideration of your participation in the Orlando Critical Mass bicycle ride, you hereby release, waive, discharge, and covenant not to sue the following parties ("Released Parties"):

  • Orlando Critical Mass organizers and volunteers

  • The City of Orlando and its employees and agents

  • Any and all landowners and property owners along the ride route

  • Any and all sponsors and supporters of the ride

from any and all liability for any and all claims, demands, losses, damages, actions, or causes of action of any kind whatsoever, including but not limited to:

  • Negligence

  • Gross negligence

  • Breach of contract

  • Strict liability

arising out of or relating to your participation in the ride, whether caused by the negligence of the Released Parties or otherwise.

3. Indemnification:

You agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, demands, losses, damages, actions, or causes of action of any kind whatsoever, including but not limited to those arising out of or relating to your participation in the ride, whether caused by your negligence or otherwise.

4. Medical Treatment:

You understand that you are responsible for your own medical care and expenses, including any and all costs associated with any injuries you may sustain during the ride.

5. Legal Compliance:

You agree to comply with all applicable traffic laws and regulations during the ride.

​

6. Waiver of Rights:

You understand that by signing this Waiver, you are giving up valuable legal rights, including the right to sue the Released Parties for any injuries or damages you may sustain.

7. Governing Law:

This Waiver shall be governed by and construed in accordance with the laws of the State of Florida.

​

8. Severability:

If any provision of this Waiver is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.   

 

9. Entire Agreement:

This Waiver constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.   

 

10. Binding Effect:

This Waiver shall be binding upon and inure to the benefit of the parties hereto and their respective heirs, successors, and assigns.

By signing below, you acknowledge that you have read, understand, and agree to all of the terms and conditions of this Waiver.
